The Move Over Law in Ontario sets strict rules for how drivers must respond when approaching or being approached by emergency or roadside service vehicles. Fail to Move Over for Emergency Vehicle

(Section 159.1 HTA)

  • When approaching or being approached by an emergency vehicle equipped with lights and sirens, the driver shall immediately bring their motor vehicle to the right-hand curb or edge of the roadway and clear any intersection.
  • Failure to do so can result in a fine of $400-$2000 and 3 demerit points
  • Repeat/subsequent offences – the fine will increase to $1000 to $4000, and possible imprisonment up to 6 months

Slow Down Approaching Emergency or Tow Truck

(Section 159.2 HTA)

  • When approaching a vehicle with its lights flashing, on the same side of the highway, you shall slow down and proceed with caution to protect everyone at the roadside.

Slow Down Approaching Stopped Emergency Vehicle or Tow truck on a Multi-Lane Highway

(Section 159.3 HTA)

  • When approaching a vehicle with its lights flashing, on a multi-lane highway (2 or more lanes in the same direction), you must (if safe to do so) move to another lane in addition to slowing down and proceeding with caution.
